Partner Terms and Conditions for Hosts – ferienhausliebe
1. Scope and Role of ferienhausliebe
1.1. These terms govern the cooperation between ferienhausliebe (“Platform”) and the respective host (“Host”).
1.2. Ferienhausliebe operates a curated platform for the presentation and booking of selected holiday accommodations and provides curated presentation and service offerings.
1.3. Ferienhausliebe is not a tour operator and not a legal representative of the host.
1.4. Ferienhausliebe provides a technical infrastructure as well as marketing and service offerings.
2. Scope of Services by ferienhausliebe
2.1. ferienhausliebe offers, in particular:
- Curated presentation of the accommodation
- Editorial preparation (texts, image selection)
- Visibility via website and selected channels
- Provision of booking infrastructure
- Technical integration of payment processing
2.2. Ferienhausliebe does not undertake operational management of the accommodation and is not involved in the execution of the stay.
2.3. Ferienhausliebe does not provide payment services requiring authorization under PSD2.
3. Conclusion of Contract and Booking Confirmation
3.1. The accommodation contract is concluded exclusively between the host and the guest.
3.2. The host decides on the acceptance of booking inquiries.
3.3. The host commissions ferienhausliebe to technically transmit booking confirmations on behalf of the host.
3.4. In this regard, ferienhausliebe does not act as a representative in the legal sense, but exclusively as a technical transmitter of the host’s declaration.
3.5. The host ensures that only bookings that comply with their specifications (availability, prices, conditions) are confirmed.
3.6. The presentation of accommodations on the platform does not constitute a legally binding offer. A binding booking is only created with the host’s explicit booking confirmation, which can be technically transmitted by ferienhausliebe.
4. Prices, Availability, and Content
4.1. The host is solely responsible for:
- Setting of prices
- Maintenance of availabilities
- Accuracy of all information about the accommodation
4.2. The host ensures that all content (texts, images, and information) is correct and up-to-date.
4.3. Ferienhausliebe reserves the right to editorially adapt content without changing its essential meaning.
4.4. Availability and Technical Transmissions
Despite careful maintenance of content, technical transmission errors, synchronization discrepancies, or short-term changes in availability and prices may occur in individual cases.
A booking is therefore only considered bindingly confirmed with an explicit booking confirmation from the host or via the platform.
ferienhausliebe assumes no liability for technical errors outside its sphere of influence, particularly in connection with external calendar, payment, or booking systems.
4.5. Tourist Tax and Local Levies
If local tourist taxes, visitor’s taxes, or similar fees apply, these are determined and collected by the respective accommodation.
Payment is made – unless otherwise specified – directly to the host on-site or as part of the booking process.
ferienhausliebe has no influence on the amount or the local legal requirements of these levies.
5. Payment Processing (Stripe / PSD2)
5.1. Payment processing is carried out exclusively via external payment service providers, particularly via Stripe or Stripe Connect.
5.2. The host is the recipient of the booking payment.
5.3. Ferienhausliebe does not receive payments or forward funds. Ferienhausliebe is never the payment recipient. Payment is made via the external payment service provider.
5.4. The host undertakes to set up and maintain a corresponding account with the payment service provider.
5.5. Payouts are made directly by the payment service provider to the host.
5.6. Payment timing and future partial payments
The payment terms are transparently displayed in the respective booking process.
Currently, the full booking amount is generally due at the time of booking, unless otherwise specified in the booking process.
Ferienhausliebe reserves the right to offer advance payments, remaining payments, or other payment models in the future – especially if technically implemented via the payment service provider used. In this case, the payment conditions displayed in the booking process shall apply.
The host agrees to the payment processing used by ferienhausliebe and displayed in the booking process.
6. Service Fee
6.1. For bookings made via ferienhausliebe, a service fee of currently 15% of the accommodation price is charged.
6.2. This service fee is:
- borne by the guest,
- transparently displayed in the booking process, and
- processed via the payment service provider.
6.3. The host receives their specified accommodation price minus applicable payment service provider fees and, if applicable, other technically related transaction costs.
6.4. Hosts incur no setup, membership, or commission costs. Only the fees of the payment service provider Stripe for payment processing apply (currently typically 1.5% + €0.25 per successful card payment within the European Economic Area – further info: Prices and Fees | Stripe).
6.5. Taxes and Billing
Regardless of the fact that the platform service fee is economically borne by the guest, ferienhausliebe prepares the necessary billing documents according to the respective payment and processing model used.
The billing documents serve as transparent documentation of ferienhausliebe’s platform and service offerings.
Each party remains solely responsible for the tax treatment and declaration of its revenues, fees, and any applicable VAT in accordance with the respective applicable legal provisions.
If both parties are located within the EU internal market and have a valid VAT identification number, billing will be carried out according to the reverse-charge procedure (§ 13b UStG).
In this case, the host owes the VAT in their own country.
The host undertakes to provide a valid VAT identification number, if available, and to promptly notify of any changes to their VAT situation.
6.6. Cleaning Costs and Payment Processing
Any cleaning costs are included in the total price set by the host and are transparently displayed to the guest during the booking process.
Payment processing is carried out via the payment service provider used by ferienhausliebe (e.g., Stripe). Transaction and payment service provider fees may apply.
If the host expressly wishes, cleaning costs can be excluded from online payment processing. In this case, the cleaning costs are paid directly on-site by the guest to the host. The host is obliged to clearly inform the guest about this before the booking is completed.
7. Host Obligations
7.1. The host undertakes to:
- provide the accommodation as described,
- duly fulfill bookings,
- comply with legal requirements, and
- respond to inquiries and bookings promptly.
7.2. The host is responsible for:
- communication with the guest,
- key handover, and
- the execution of the stay.
7.3. The host ensures that they are authorized to rent out the property.
8. Cancellations and Conditions
8.1. The host determines the cancellation conditions themselves.
8.2. These must be transparently displayed in the booking process.
8.3. The host is responsible for processing cancellations. This is technically handled via the Stripe integration.
8.4. Insofar as a payment claim against the guest remains according to the cancellation conditions set by the host, the platform service fee attributable thereto also remains.
9. Subsequent Bookings
Guests referred via ferienhausliebe are considered part of this cooperation for the first booking.
Subsequent stays can then be handled directly between the host and the guest, unless a different agreement has been made.
10. Liability
10.1. The host is liable for:
- the execution of the stay,
- the accuracy of the information, and
- damages related to the accommodation.
10.2. Ferienhausliebe is exclusively liable for its own breaches of duty within the scope of the service platform.
10.3. Any liability of ferienhausliebe for the host’s services is excluded.
10.4. Ferienhausliebe is not liable for damages or incidents related to the stay, accommodation, or services of the host, unless there is an intentional or grossly negligent breach of duty by ferienhausliebe.
10.5. Ferienhausliebe is not liable for loss of profit or indirect damages.
11. Term and Termination
11.1. The cooperation begins with the listing of the accommodation on the platform.
11.2. Both parties can terminate the cooperation at any time with 14 days’ notice.
11.3. Already confirmed bookings remain unaffected by this.
12. Brand Presence and Content
12.1. The host grants ferienhausliebe the right to use provided content for presentation and marketing purposes.
12.2. Ferienhausliebe pursues a curated approach and reserves the right to select or reject accommodations.
13. Final Provisions
13.1. German law applies.
13.2. The place of jurisdiction is – as far as legally permissible – the registered office of ferienhausliebe in Bremen.
13.3. Should individual provisions be or become invalid, the validity of the remaining provisions remains unaffected.
